Terms of Service

Please read these Terms of Service ("Terms") carefully before using Paw Plan. By creating an account, completing a purchase through our checkout, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About These Terms

These Terms form a binding agreement between you ("you", "your", "User") and Paw Plan ("Paw Plan", "we", "us", "our"), the provider of the Paw Plan dog-training application and related services available at paw-plan.com.

Purchases of any Paw Plan subscription or one-time product are processed by Whop Inc. ("Whop"), which acts as the merchant of record for the transaction. Whop's own terms of service (available at https://whop.com/terms) apply to the payment relationship in addition to these Terms. These Terms govern your use of the Service itself.

2. Definitions

  • "Service" means the Paw Plan web application, all content within it, the optional Add-on Services, and any related communications.
  • "App" means the Paw Plan web application accessible at paw-plan.com (and any subdomains), including personalized training plans, tracking tools, and the health journal.
  • "Add-on Services" means optional features that can be purchased separately, including the Bark Button (digital) and Video Lessons.
  • "Subscription" means any recurring access plan offered through our Whop checkout (monthly or annual).
  • "Initial Term" means the first paid billing period of a Subscription (or the duration of a Trial, where applicable).
  • "Renewal Term" means each subsequent billing period that follows the Initial Term until the Subscription is cancelled.
  • "Trial" means any introductory period (free or discounted) offered with a Subscription, after which the Subscription automatically converts to the regular price.

3. Eligibility

To use the Service you must be at least 18 years old and legally able to enter into a binding contract. By using the Service you represent that you meet these requirements, that the payment method used at checkout is yours (or that you are authorized to use it), and that the information you provide is accurate.

4. Account Registration

To access the App you must create an account with a valid email address. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@paw-plan.com if you suspect any unauthorized use.

You may not share, transfer, sell, or sublicense your account. Each account is for a single User and household.

5. Description of Service

5.1 Core Service (included with every Subscription)

  • The Paw Plan App — a personalized dog-training plan generated from information you provide about your dog, plus tracking tools and a health journal.

5.2 Add-on Services (sold separately, not included by default)

The following are optional digital products that you may purchase in addition to a Subscription. They are not included in the standard Subscription unless you have separately purchased them at checkout or through an upsell:

  • Bark Button — a digital training tool delivered inside the App.
  • Video Lessons — step-by-step training videos.

5.3 Digital delivery only

The Service is 100 % digital. There is no physical product, no shipping, and no postal delivery. Access to the Service is provided through the App immediately after purchase.

6. Subscriptions, Pricing & Auto-Renewal

6.1 Plans

Paw Plan offers monthly and annual Subscription plans. The exact price, billing frequency, and any Trial terms are displayed at checkout before you complete your purchase. By completing checkout, you confirm that you have read and accepted those terms.

6.2 Authorization for recurring billing

You expressly authorize Paw Plan, through Whop, to charge your selected payment method on a recurring basis — once per billing period (monthly or annual, depending on your plan) — without further action by you, until you cancel as set out in Section 9.

6.3 Renewal price

Unless we notify you in advance of a price change, the Renewal Term will be billed at the same recurring price disclosed at checkout for your plan. Any price change will be communicated to you by email before it takes effect, and you may cancel before the change to avoid being charged the new price.

6.4 Statement descriptor

Recurring charges may appear on your bank or card statement as "WHOP" or "WHOP.COM". This is normal — Whop is the merchant of record and processes the charge on our behalf.

6.5 Renewal reminders

Where required by applicable law, we (or Whop on our behalf) will send you a reminder by email before each Renewal Term so that you have an opportunity to cancel. The absence of such a reminder does not affect your authorization in Section 6.2.

7. Free Trials & Promotional Offers

Some Subscription plans may be offered with a free trial or a discounted introductory period. Where this is the case:

  • The duration, the introductory price (if any), and the regular price that will apply after the Trial are clearly displayed at checkout.
  • You authorize the post-Trial charge automatically. When the Trial ends, your Subscription will convert to the regular plan and your payment method will be charged the regular recurring price unless you cancel before the Trial ends.
  • You may cancel at any time during the Trial through the channels described in Section 9. Cancellation during the Trial takes effect immediately and you will not be charged the regular recurring price.

Promotional offers (discounts, coupons, bundles) are valid only as described at the time of purchase, may not be combined with other offers, and may be withdrawn at any time.

8. Payment Processing & Whop

All purchases are processed by Whop Inc., which acts as the merchant of record. This means:

  • Whop collects payment, issues invoices and receipts, and remits any applicable sales tax.
  • Whop's own terms of service and privacy policy (https://whop.com/terms) apply to the payment relationship in addition to these Terms.
  • For questions about a charge, refund processing time, payment method updates, or billing receipts, please contact us first at support@paw-plan.com — we will coordinate with Whop on your behalf.
  • Your bank or card statement will show the descriptor noted in Section 6.4.

We do not store your full payment card details. Card data is collected and processed by Whop and its payment partners.

9. Cancellation

You may cancel your Subscription at any time through either of the following channels:

  1. Self-service — log in to your Whop account at https://whop.com and cancel from your subscription dashboard.
  2. By email — send a cancellation request to support@paw-plan.com from the email address associated with your Subscription.

Cancellation takes effect at the end of your current billing period. You will retain access to the paid features of the Service until that date and you will not be billed for any further Renewal Terms. No partial-period refunds are issued except as set out in Section 10.

We will not impose any technical, procedural, or administrative obstacles to cancellation. Cancelling is at least as easy as signing up.

10. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee:

  • On your initial purchase: if you are not satisfied with the Service, request a refund by emailing support@paw-plan.com within 30 days of your initial purchase and we will issue a full refund through Whop.
  • On Subscription renewals: if you are charged for a Renewal Term and request a refund within 30 days of that renewal charge, we will issue a pro-rated refund for the unused portion of the renewal period (calculated from the date your refund request is received).

Refunds are processed through Whop and may take 5 to 10 business days to appear on your statement. Refunds are issued to the original payment method.

The money-back guarantee does not apply where these Terms have been terminated for breach (see Section 17) or in cases of suspected abuse (see Section 11).

11. Chargebacks & Dispute Resolution Before Chargeback

This section is important. By using the Service you agree to the following:

11.1 Contact us first

Before initiating a chargeback or payment dispute with your card issuer, bank, or Whop, you agree to first contact us at support@paw-plan.com and allow us 7 business days to resolve your concern. Most issues — including unrecognized charges, refund requests, and cancellation problems — can be resolved quickly and amicably this way.

Initiating a chargeback without first contacting support, or while a refund is being processed, constitutes a breach of these Terms.

11.2 Acknowledgment of authorization

You acknowledge and agree that:

  • Each purchase made through the Whop checkout was authorized by you at the time of purchase.
  • Where you purchased a Subscription, you also authorized the recurring charges described in Section 6.2.
  • Where you purchased a plan with a Trial, you also authorized the post-Trial charge described in Section 7.

11.3 Chargeback abuse

We treat the following as chargeback abuse:

  • Filing a chargeback after receiving access to or actively using the Service.
  • Filing a chargeback for a Subscription renewal that was disclosed at checkout and could have been cancelled.
  • Filing a chargeback after the 30-day money-back guarantee window has passed without first requesting a refund through support.
  • Filing repeated or frivolous chargebacks.

If you engage in chargeback abuse we may, in addition to defending the chargeback with evidence: (a) immediately terminate your account and access to the Service without refund; (b) recover the chargeback amount and any associated fees; and (c) decline to provide service to you in the future.

11.4 Right to dispute is preserved

Nothing in this Section eliminates your legal right to pursue a chargeback through your card issuer or Whop where appropriate. This Section requires only that you contact us first and act in good faith.

12. Acceptable Use

You agree not to:

  • share, sell, transfer, or sublicense your account or your access to the Service;
  • copy, reproduce, modify, distribute, publish, or publicly display any part of the Service or its content without our prior written permission;
  • reverse-engineer, decompile, scrape, or attempt to extract the source code or underlying data of the Service;
  • use the Service for any unlawful purpose, or in any way that infringes the rights of others;
  • use the Service to harass, abuse, threaten, or harm any person or animal;
  • resell, white-label, or commercially exploit the Service in any way;
  • attempt to interfere with the security, integrity, or availability of the Service.

13. Intellectual Property

All content within the Service — including but not limited to text, training plans, video, audio, graphics, logos, software, and the "Paw Plan" name and brand — is owned by Paw Plan or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use with your own dog. This license does not include any right to copy, redistribute, or create derivative works.

14. Disclaimers — No Veterinary Advice, No Guarantee of Results

Please read this section carefully. By using the Service you accept the following:

14.1 Not veterinary, behavioral, or medical advice

Paw Plan provides general dog-training information and guidance. The Service is not a substitute for the professional judgment of a licensed veterinarian, board-certified veterinary behaviorist, or in-person professional dog trainer. We do not diagnose, treat, cure, or prevent any medical, behavioral, or psychological condition in your dog.

If your dog shows signs of illness, injury, pain, or distress, contact a veterinarian. For behavioral concerns including aggression, severe anxiety, fear, reactivity, biting, or sudden behavioral changes, consult a qualified veterinary behaviorist or professional trainer in person.

14.2 No guarantee of results

Dog training depends on many factors — including the dog's breed, age, history, health, environment, and the consistency of the handler. We make no guarantee, express or implied, that any specific result will be achieved. Results vary from dog to dog and household to household.

14.3 Not suitable for certain dogs

The Service is not designed for and not suitable for dogs that:

  • have a history of biting humans or other animals;
  • show aggression, severe anxiety, fear, or reactivity;
  • have neurological, orthopedic, endocrine, or other medical conditions affecting behavior;
  • are recovering from injury or surgery.

If your dog falls into any of these categories, do not rely on the Service. Seek in-person professional help.

14.4 As-is

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) PAW PLAN, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

(b) WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY INJURY, DAMAGE, OR LOSS — INCLUDING TO YOU, YOUR DOG, ANY OTHER PERSON OR ANIMAL, OR ANY PROPERTY — RESULTING FROM YOUR APPLICATION OF, OR RELIANCE ON, ANY TRAINING METHOD, RECOMMENDATION, OR INFORMATION PROVIDED THROUGH THE SERVICE.

(c) OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (THROUGH WHOP) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD 100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Paw Plan, its officers, directors, employees, contractors, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • your use of, or inability to use, the Service;
  • your breach of these Terms;
  • your violation of any applicable law or third-party right; or
  • any injury, damage, or loss caused by your dog or by your application of any training method or recommendation provided through the Service.

17. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice and without refund, if we reasonably believe that you have:

  • breached these Terms (including the Acceptable Use rules in Section 12 or the chargeback rules in Section 11);
  • engaged in fraud, abuse, or unlawful conduct;
  • created a risk to us, to other Users, or to any third party.

You may stop using the Service at any time by cancelling your Subscription as set out in Section 9. The provisions of Sections 11–18 and 20 survive any termination of these Terms.

18. Governing Law, Arbitration & Class Action Waiver

18.1 Governing law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.

18.2 Binding individual arbitration

You and Paw Plan agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual action in small-claims court for claims that qualify.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect (available at https://www.adr.org). The arbitration will be conducted in the English language and seated in the United States (the parties may agree on a specific city; absent agreement, the seat is Wilmington, Delaware). The arbitrator's award will be final and may be entered as a judgment in any court of competent jurisdiction.

18.3 Class action waiver

You and Paw Plan agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

18.4 Chargebacks preserved

Nothing in this Section 18 limits your right to pursue a chargeback through your card issuer or Whop in accordance with applicable card-network rules and Section 11 of these Terms.

18.5 Opt-out

You may opt out of the arbitration agreement and class-action waiver in this Section 18 by sending written notice to support@paw-plan.com within 30 days of first accepting these Terms. Your notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version at paw-plan.com/terms and update the "Last Updated" date at the top.

For material changes that affect your rights or obligations, we will give you reasonable advance notice by email or through the Service. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of those Terms. If you do not agree, you must stop using the Service and may cancel your Subscription as set out in Section 9.

20. Severability & Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

These Terms (together with the Whop terms applicable to your purchase and our Privacy Policy) constitute the entire agreement between you and Paw Plan regarding the Service and supersede any prior agreements or understandings.

Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision.
